1. Acceptance of Terms
By accessing or using AIWhatsApp ("Service", "Platform") at aionechat.com, you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
2. Description of Service
AIWhatsApp provides a multi-tenant WhatsApp Business API platform that allows businesses to send and receive WhatsApp messages, manage templates, run broadcasts, and automate conversations via Meta's WhatsApp Cloud API.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or bulk messages to users who have not opted in.
- Transmit illegal, harmful, or fraudulent content.
- Violate Meta's WhatsApp Business Policy or Commerce Policy.
- Attempt to reverse-engineer, scrape, or disrupt the platform.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Billing & Payments
- Platform subscription fees are billed monthly or annually as selected at signup.
- WhatsApp conversation costs are charged at Meta's actual rates with zero markup, deducted from your prepaid wallet balance.
- All fees are non-refundable unless otherwise stated in writing.
- Failure to maintain sufficient wallet balance may result in message delivery being paused.
6. Data & Privacy
Your use of the Service is governed by our Privacy Policy. We process message and account data solely to deliver the Service. You retain ownership of your content and customer data.
7. WhatsApp & Meta Compliance
You are solely responsible for ensuring your use of the WhatsApp Business API complies with Meta's policies. AIWhatsApp is not liable for account restrictions or bans imposed by Meta due to policy violations on your part.
8. Intellectual Property
All platform code, design, trademarks, and branding are owned by AIWhatsApp. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.
9. Limitation of Liability
To the maximum extent permitted by applicable law, AIWhatsApp shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
10. Termination
We may suspend or terminate your account for violation of these terms. You may cancel your subscription at any time from your dashboard; access continues until the end of the current billing period.
11. Changes to Terms
We may update these terms from time to time. We will notify you via email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
